About us
Over the last decades the number of litigations in the Netherlands and Western Europe has grown significantly and so has the need for funding. LCE has recently entered into the market of litigation finance, and is backed by Arrowhead Capital, a major USA litigation fund. MCLP will assist those who have legitimate claims, but do not have the means, or in some instances, the willingness to pursue them.

What is ligitation funding?
Problem
Every company may from time to time run into conflicts and disputes. Such conflicts and resultant claims may arise out of contract breaches, business torts, professional mal practices, anti-competition cases, intellectual property infringements, bankruptcies and insolvencies. Claimants may not always be able or willing to invest their time and money, even when there’s a high chance of a positive outcome. This is where LCE can step in.
Checklist
A claim can be eligible for funding based on certain criteria. LCE can provide funding when the claim:
- is at least €2.000.000
- has jurisdiction in the Netherlands or Western Europe.
- has substantive ground for pursuing, incl. credible documentary evidence.
- is recoverable, meaning the defendant has to have substantial assets that can be the target of the litigation.
Process
The claim will be thoroughly screened and will be subjected to due diligence. When accepted, LCE will make funds available in order to pursue the claim. For the duration of the litigation an account manager is appointed to the case, to communicate and interact with the client, as well as with the lawyers handling the litigation.
Outcome
When a claim is successfully litigated, LCE will receive the agreed upon share of the outcome. In case of a loss, LCE will lose its investment without recourse to the client.
